That guy has responded and removed my theme from his site, so it can be downloaded only from our sites.
I also changed the license information page on this website to reflect some of the recent happenings.

Can’t we do something about it? Maybe issue a C&D or a DMCA?

Well there is nothing you guys can do much unless he is removing your copyright notice. If the Themes are released under GPL or CC share alike then he does have the right to modify and add his links i.e. without removing your copyright links if he wants.
